GENERAL TERMS AND CONDITIONS OF VESSEL RENTAL
Article 1.
Estas Dubrovnik d.o.o. (hereinafter: Lessor) guarantees the technical correctness and good
condition of all its vessels.
The person who confirms the reservation, i.e. pays the advance payment (hereinafter referred to as:
the Client), establishes a legal relationship with the Lessor, and thereby confirms that he agrees with
these “General Terms and Conditions of Vessel Rental”.
Everything published in these conditions represents a legal obligation for both the Client and the
Lessor.
These conditions are the basis for resolving any disputes between the Client and the Lessor.
Price and terms of payment
Article 2.
The prices of rental services are published in Euros (€), on the official website of the Lessor, and at
all points of sale.
Prices from Art. 2.1. of these General Conditions include a technically correct, clean vessel with all
safety equipment and fuel.
The stated price does not include a parking space, the Client’s health insurance, or additional
services that are not listed in the Lessor’s offer.
After confirming the reservation, the Client is obliged to honor it or cancel/change it in agreement
with the Lessor (the Lessor reserves the right to cancel/change the reservation in case of bad
weather conditions or violation of the General Terms and Conditions by the Client).
The Client is obliged to pay the entire amount of the rental price immediately before taking over the
vessel for use, while in certain cases he is obliged to pay immediately after using the vessel in the
manner and under the conditions set forth in further provisions.
Taking over the vessel
Article 3.
When taking over the vessel, the Client reserves the right to inspect it for the purpose of
determining technical correctness, and if he notices any defects, to immediately notify the Lessor.
The Client is obliged to take care of the boat during the boat rental, and to return it in good
condition.
Upon return, the Lessor inspects the vessel in the presence of the Client.
If the vessel is returned at the agreed time, to the agreed place, orderly and undamaged, under
condition that there are no complaints from third parties in relation to the Client, which are related
to his use of the rented vessel, the Lessor will not claim additional compensation. In the event that
some of the aforementioned clauses are not respected, the Client is obliged to pay the damage
(delays or damage on the vessel) to the Lessor immediately when returning the rented vessel.
In the event that the Client does not return the vessel within the agreed time, the Lessor’s claim will
amount to €10 (in letters: ten euros) for every 5 min (in letters: five minutes) of delay, and in case of
a delay of more than 1 h (in letters: one hour), the Lessor reserves the right to claim payment of the
entire service amount according to the Lessor’s official price list.
If damage/loss of the vessel or equipment makes it impossible to rent the vessel further on, the
Lessor reserves the right to claim full payment of the damage or part of the equipment, regarding
the catalog price.
If the Client, without prior notice, does not take over the vessel within 30 minutes (in letters: thirty
minutes) at the latest from the agreed time, the Lessor is authorized to make the vessel available to
the next Client.
Any complaints about the condition of the vessel are submitted exclusively before the start of
the use of the vessel.
Rules of use of the vessel
Article 4.
The Client undertakes to comply with the Lessor’s following rules for using the vessel:
When setting sail, the first 300 m (in letters: three hundred meters) must be moved very slowly, in
order to leave the nearest coastal area as safely as possible.
When sailing, keep a distance of 300 m (in letters: three hundred meters) from the shore, because of
possible swimmers and beach users.
The Client is obliged to be alert at all times and, in the event of encountering other participants in
maritime traffic, to take evasive measures.
The minimum distance between two vessels (under lease or others) must be at least 100 m (in
letters: hundred meters), and these vessels must not cross each other’s navigation paths.
The Lessor’s vessels has a GPS system that monitors the movement of the boat.
In case of violation of some of the stated rules, the Lessor reserves the right to terminate the lease.
Prohibited entry zones are:
• Port of Gruž (due to heavy maritime traffic and the movement of passenger and liner ships);
• The harbor in front of the Old Town (for the same previously stated reason);
• Lapad Bay (due to the large number of hotel beaches and the large number of bathers on
them).
If the Client gets too close to the shore or one of the beaches, the vessel will only slow down, in
case of entering one of the prohibited zones, after slowing down, it will also turn off. After leaving
these zones, the speed limit will be removed from the vessel.
When the rental time expires, the vessel will sound a sound signal that informs the Client to return
the vessel to the place of departure. In the event that the vessel is unable to sound the signal, an
other sign of the end of the time will be highlighted to the Client when the vessel is taken over for
use.

brings a written complaint when returning the boat and submits all the necessary documentation and
photos.
The written complaint must be signed by both the Client and the Lessor. Complaints received
